By accessing or using services provided by Genko AI Solution Private Limited, you agree to be bound by these Terms of Service. If you do not agree, you may not use our services.
Genko AI provides AI-powered chatbot and ticket automation solutions delivered as a cloud-based SaaS platform. We reserve the right to modify, suspend, or discontinue any aspect of the service with reasonable notice.
All platform code, algorithms, models, documentation, and branding are the exclusive property of Genko AI Solution Private Limited. Customers retain ownership of their data and content uploaded to the platform.
We target 99.9% uptime for all paid plans. In the event of extended downtime beyond our SLA, affected customers may be eligible for service credits as described in their service agreement.
To the maximum extent permitted by law, Genko AI shall not be liable for indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.
Either party may terminate the agreement with 30 days' written notice. Upon termination, we provide a 30-day window for data export. We may terminate immediately for material breach of these terms.
These terms are governed by the laws of India. Disputes shall be resolved through arbitration in accordance with the Arbitration and Conciliation Act, 1996.

Genko AI Solution Private Limited is committed to GDPR compliance for all users in the European Economic Area (EEA). We process personal data lawfully, fairly, and transparently.
Under GDPR, you have the right to: access your data, rectify inaccurate data, erase your data ("right to be forgotten"), restrict processing, data portability, object to processing, and not be subject to automated decision-making. Submit requests to gdpr@genkoai.com. We respond within 30 days.
We maintain DPAs with all sub-processors. A current list of sub-processors is available upon request. We notify customers 30 days before adding new sub-processors.
When data is transferred outside the EEA, we use Standard Contractual Clauses (SCCs) approved by the European Commission to ensure adequate protection.

All paid plans include a 14-day free trial. No credit card is required. You will not be charged unless you explicitly upgrade to a paid plan.
Monthly subscriptions can be cancelled at any time. You will retain access until the end of your current billing period. No partial-month refunds are issued for cancellations mid-cycle.
Annual subscriptions may be refunded within 30 days of purchase if you are unsatisfied with the service. After 30 days, you may cancel but the remaining balance is non-refundable. Access continues until the end of the billing period.
Email billing@genkoai.com with your account email and reason for the refund request. We process refund requests within 7 business days. Refunds are issued to the original payment method.
Refunds are not available for: custom enterprise contracts (governed by individual agreements), accounts terminated for Terms of Service violations, or usage-based overages already consumed.
